Regulamin
TITLE I – Preliminary Provisions
1. Ownership and Purpose – The Baia Holiday Gasparina campsite is managed by the company Baia Camping Village srl, with head office in Salò (BS), p.zza Vittorio Emanuele II n° 31, VAT number and tax code 03065190989, hereinafter referred to as „BCV”. The same provides in favour of its customers the accommodation service as defined by the regional regulations for the individual accommodation facilities.
TITLE II – Procedures
CHAPTER I – Provision of the service
SECTION I – Parties admitted to the provision
2. Admissions – The campsite service is provided exclusively to groups of a minimum of 2 and a maximum of 6 members. The service may be provided to groups, however formed, in full compliance with these regulations by the members of the group. Minors under 25 years of age, when not constituting a family nucleus or if not guests of customers, are reserved a specific area within the accommodation facility.
3. Guests – Customers are permitted to receive guests inside the accommodation facility. Guests are only admitted during the opening hours of the Reception Office and upon payment of the appropriate fee. Guests under the age of 18 are not admitted, unless accompanied by an adult, who is obliged to watch over their conduct during their entire stay in the accommodation facility, and who shall be answerable to BCV and third parties for all legal purposes.
SECTION II – Reservations and Stay Limits
4. Booking limits – The booking of stays, except for certain special offers made by BCV, can only be made with the tour operator CVMI srl – Baia Holiday. For booking conditions, see therefore what is stated in the Baia Holiday catalogue and/or website.
5. Exclusions – BCV reserves the right to consider as unwelcome, and therefore not admitted, guests who do not have or do not meet the requirements set out in the following points.
CHAPTER II – Check-in
6. Arrival and registration – The reception of customers and the completion of registration formalities at the Reception Desk is only permitted during the hours displayed at the entrance to the accommodation facility. At the time of registration, customers and their guests must communicate their personal details to BCV. In the event of subsequent changes concerning persons, services, and guests, the customer undertakes to inform the Acceptance Office. If a member is found without registration, the account will be debited from the first day of arrival of the crew to which it relates.
7. Allocation of mobile home – pitch („Village” and „Campsite” customers) – Customers are obliged to occupy the mobile home or pitch indicated to them at the Acceptance Office, or to wait for an accompanying person to show them the one allocated to them. Occupation of a pitch other than the one assigned is only permitted with the express written authorisation of the Acceptance Office, with the completion of a new registration procedure.
CHAPTER III – Check-out
8. Departure – Customers must leave the campsite on the last day of their stay, by the following times
– by 10 a.m., if equipped with a camper van, caravan or tent;
– by 9 a.m., if staying in a mobile home or bungalow.
9. Payment – Payment of the amount due for the stay, as well as any other ancillary services for which immediate payment is not envisaged, is only permitted during the opening hours of the Cashier’s Office. Payment must be made no later than the day before the departure date, except for advance payment if requested by Management, at its sole discretion. The customer is obliged to show the tax documentation proving payment, to the staff in charge of such control placed at the exit of the structure.
10. Deposit – At the time of registration, the customer staying in a mobile home or bungalow may be asked to pay a sum of money, not bearing interest, as a deposit for any damage caused to property and equipment, equipment, identification bracelets, which will be returned to him/her on departure. This is without prejudice to BCV’s right to compensation for any greater damage caused.
TITLE III – Rules of conduct for customers and their guests
CHAPTER I – Prohibitions
11. Respect for vegetation – It is forbidden to alter in any way or by any means the existing flora within the premises.
12. Fire safety – It is forbidden to light open fires on the entire area of the accommodation facility and its appurtenances. The more restrictive regulations of the Authorities responsible for the protection and conservation of heritage are reserved. The use of the cooking grills located within the campsite is only authorised on days when there is no „moderate” wind greater than force 3 on the Beaufort scale (wind speed between 5.5 and 8 m/s) and strictly adhering to the instructions for use displayed at each grill. The use of gas cookers within the pitches is authorised at a distance of more than 1 metre from the surrounding vegetation, while the use of candles and gas lamps for lighting purposes is prohibited. The maximum amount of portable containers containing explosive gas (liquid propane gas) is 30 kg per family group. Smoking is forbidden inside the buildings open to the public located in the camping village as well as in the technical rooms.
13. Disposal of waste – It is forbidden to dispose of waste outside of the appropriate containers in accordance with the regulations in force regarding separate waste collection. It is forbidden to dispose of waste water, of any type and from any source, outside the appropriate points of use located inside the campsite (compulsory procedure for the discharge of sewage from caravans and camper vans) and/or outside the toilets.
14. Use of cables and electrical equipment – It is forbidden to obstruct the roadways located inside the accommodation facility with cables and/or any other instrument for the derivation of electrical energy; it is also forbidden to place them in the surrounding vegetation. The personnel of the accommodation facility are expressly authorised to immediately disconnect without notice any cable and/or other instrument affixed in violation of the preceding paragraph. The same authorisation shall be given in the case of electrical connections found to be non-compliant with the regulations in force.
15. Use of public address equipment – It is forbidden to behave in such a way as to disturb the public peace inside the accommodation facility and its appurtenances, as well as on the beach in front of it. It is forbidden to set up or fold camping equipment, to speak in a tone of voice that is not appropriate to the peace and quiet that is intended to be guaranteed during these periods and to use mechanical means, within the time slots set out inside the accommodation facility and in any case set out in the Accommodation Regulations. The Management, at its sole discretion, may make exceptions for entertainment activities. Both nudity and toplessness are expressly forbidden inside the campsite; nudity is also forbidden for children, inside the shops, restaurants and bars.
16. Pets – Pets are allowed inside the facility. For the regulation of the presence of pets, please refer to the rules listed in the specific regulations.
17. Alterations to the pitch – It is forbidden to alter the state of the assigned pitch in any way, unless such a requirement is justified by particularly adverse weather conditions that jeopardise the safety of people and/or property; in this case, the customer is obliged to immediately restore the state of the premises when such conditions cease, at his or her own care and expense.
18. Playground – It is forbidden to use the static playground for children under the age of 3 and over the age of 12. Access to the playground is only allowed during the hours established by the Management, and to children accompanied by adults, who are responsible for it to all legal effects towards BCV and third parties.
19. Use of electricity supply systems – The use of electricity supply systems on the pitches is for the exclusive use of caravans, campers, caravans and domestic equipment. The use of such systems to recharge electric cars is expressly forbidden, as this could lead to faults in the electricity grid as well as in your car. In the event of any violation of this prohibition, the camping village management reserves the right to impose a fine of Euro 300.00 on offenders.
CHAPTER II – Access to and use of means of transport within the campsite
20. Cars – The use of cars is only authorised for unloading on arrival and loading on departure, camping equipment and luggage. No more than 2 hours may be spent on each of these operations, unless expressly authorised in writing by the Reception Office. It is not permitted to wash one’s own car, caravan, and/or boat, etc., on the campsite.
21. Motorhomes – Access to the campsite by motorhomes is permitted only to those which have been duly approved, including for overnight accommodation, by the competent authorities. The staff of the Receiving Office may request the production of such documentation.
22. Restrictions – Access to playgrounds is permitted under the supervision of the minors’ parents. Use of the gyms is forbidden for minors under the age of 16. Bicycles are not permitted on the playground.
23. Circulation – Circulation within the accommodation is permitted in compliance with the traffic regulations of the Italian Highway Code, according to the relevant restrictions, obligations, vehicle characteristics, etc.. A speed limit of 10 km/h is set for circulation inside the tourist accommodation facility. The staff of the tourist accommodation is authorised to confiscate the bicycle from the minor who rides it at a speed exceeding the limit set out in the preceding paragraph or in such a way as to create danger to others; the bicycle will be made available to the adult who is responsible for the minor.
24. Parking – The accommodation facility is equipped with special parking areas located in the areas pertaining to it. It is strictly forbidden to obstruct the escape routes by any means, under penalty of forcible removal. If the obstruction is repeated for the third time with the same means, it will be confiscated and returned to the person entitled to it at the end of the stay.
CHAPTER III – Emergency Management
25. In the event of fire – Special loudspeakers (acoustic sirens) are located inside the campsite which will sound an alarm in the event of a serious fire. In the event of such an event, guests must reach in good order the „temporary collection points” indicated by appropriate signs, where they will wait for the emergency team that will lead them to the general collection point at the entrance of the accommodation facility. In the event of a fire detected by the guest, report the event immediately by pressing the appropriate emergency button on the campsite area.
26. In case of other emergencies – Health, serious natural events, public safety situations, sea incidents: contact the Campsite staff if available, operate the emergency button, or consult the information board at the entrance where all the telephone numbers for requesting help are listed.
TITLE IV – Responsibility
27. Responsibility of the customer and / or guests – Customers and / or their guests are personally liable to BCV and / or third parties for any damage to persons and / or property, direct and / or indirect, for any reason caused as a result of conduct in violation of the rules of this contract and / or other applicable. This is without prejudice to BCV’s right to compensation for greater damages. Each camper is obliged to look after his/her belongings scrupulously. The Management accepts no responsibility for any lost or stolen items not left in their care. The management accepts no liability for damage to cars, caravans or other property caused by falling branches and/or pine cones.
Responsibility of the camping village – The camping village accepts no responsibility for lost or stolen objects or valuables, for damage to persons or property not caused by direct negligence on the part of the camping village staff, for damage, disruption and breakdowns caused by bad weather or force majeure.
28. Termination – The violation of Articles 11 and 12 of this contract will result in its immediate termination, with the obligation of the customer and his guests to leave the accommodation within 6 hours of receipt of notice of termination, as well as, by way of a penalty clause, to pay the amount for the entire stay, even if the one enjoyed is less, with the right of BCV to the retention of the deposit until the satisfaction of its claims, as well as to be compensated for any greater damage. Any delay in arrival of more than 10.00 a.m. on the day following the scheduled date, or failure to give notice, will also result in immediate termination, with BCV’s right to compensation for damages.
TITLE V – Final Provisions
29. Variations – Any variation to the camping service provision regime that does not conflict with the rules of this contract is made public by posting on the notice board located at the entrance to the campsite. Any changes authorised for an individual customer shall be communicated to this customer in writing, which must be produced upon request by the campsite staff. This derogation does not constitute a source of equivalent rights in favour of third parties.
30. Disputes – This contract is subject to Italian law and for any interpretation pertaining to what is set forth herein or for what is not provided for, express reference is made to the provisions of law and in the absence thereof to custom and usage.
31. Assignment of the contract – This contract and the rights and obligations arising from it will be automatically transferred, without the need for any consent from the customer, as a result of mergers, incorporations, transfers of business or branch of business involving only BCV. BCV does not accept the assignment of this agreement to third parties by the customer.
32. Closing clauses – Any tolerances on the part of BCV, referring to conduct of customers and/or their guests that are in violation of the provisions of this contract, do not constitute any waiver of its rights under these clauses. In the event that any contractual clause, for whatever reason, does not comply with mandatory legal provisions, the same shall be ineffective, without prejudice to the validity of the remaining clauses. This contract constitutes the entire manifestation of all agreements between the parties and exhausts the regulation of their rights and obligations as far as the subject matter of the agreement is concerned. All previous and different written and oral agreements, both between the parties and towards third parties, regarding this agreement shall be considered annulled and deprived of effect. Any amendment to the terms and conditions of this agreement shall be in writing under penalty of nullity.
Your animals are welcome in our Camping Villages but, in order to avoid discomfort to the other guests, we ask you to follow and respect the following rules:
Pets are only allowed in some camping pitches and in certain types of Mobile homes, in a limited number – max 2 dogs per unit. For any exception, please, contact the camping Management.
- Animals must be registered upon booking or on arrival.
- Upon check-in, the animal’s owner must provide the vaccination certificate (EU Passport).
- The Management has the right not to accept animals if different from what declared upon booking.
- In the Camping Village you can find dispenser of biodegradable bags to be used to collect the excrements.
- Customers must take the dogs out of the Camping Village, in the dog area, and their excrements immediately removed by the appropriate bag and scoop.
- Dogs cannot be left unattended in the camping pitch/living unit.
- Outside the accommodations (camping pitch or living unit), dogs must be kept on a leash and, if aggressive dogs, even muzzled.
- Dogs are not allowed inside all the Camping Village areas. Specifically they are not allowed inside the reception, supermarket, sport facilities, children’s playground, swimming pool etc. Dogs are allowed inside the restaurant, only in the reserved area shown by the restaurant staff.
- Pets are not allowed inside the toilets. It is strictly forbidden to wash them inside the showers. They can only be washed in the reserved areas indicated by the Camping Village staff.
- Dog’s owner must prevent the animal from invading other’s pitches or living units or disturbing other customers.
- Animal access to the beach is only allowed in the areas where it is permitted and signposted. Animals may not be left unattended and must be kept on a leash at all times. Animals may not be left unattended at one’s own pitch/housing unit.
- Dog’s owner must ensure the maximum respect of the sanitary rules during the stay inside the living unit; it is forbidden to use bed linen and towels for the dog and it is strictly forbidden to let the dog jump upon tables, chairs, beds etc.
- Any damage caused by the animals to third parties and/or to the Camping Village facilities are entirely under the owner’s responsibility.
- Dogs belonging to dangerous breeds (with reference to the Ministry of Health law – N. 213 – 10/09/2004) are not allowed inside the Camping Village.
- All customers declare to have received the present list of rules upon booking or check-in and to accept them entirely.
The Management reserves the right to ask customers, who do not respect these rules, to leave the Camping Village. Particularly the Management has the right to report to the Police customers who do not respect points 5 and 6. Eventuali comportamenti di maltrattamento verso i cani saranno segnalati alle autorità competenti. Any mistreatment will be reported to the police.
